This book engages with what are widely recognized as the two core dimensions of emotion. When we are afraid, glad or disappointed, we feel a certain way; moreover, our emotion is intentional or directed at something: we are afraid of something, glad or disappointed about something. Connecting with a vital strand of recent philosophical thinking, I conceive of these two aspects of emotion as unified. Examining different possible ways of developing the view that the feeling dimension of emotion is itself (...) intentional, I argue against the currently popular view that it is a form of perception-like receptivity to value. I instead propose that emotional feeling is a specific type of response to value, an affective ‘position-taking’. This alternative conceives of emotional feeling as intimately related to our cares and concerns. While situating itself within the analytic-philosophical debate on emotion, the discussion crucially draws on ideas from the early phenomenological tradition in an attempt to think past the theoretical strictures of many contemporary approaches to this subject. The result is a new view of emotional feeling as a thoroughly personal form of engagement with value. (shrink)

It is a commonplace that emotions are characteristically passive. As we ordinarily think of them, emotions are ways in which we are acted upon, that is, moved or affected by aspects of our environment. Moreover, we have no voluntary control over whether we feel them. In this paper, I call attention to a much-neglected respect in which emotions are active, which is no less central to our pretheoretical concept of them. That is, in having emotions, we are engaged with the (...) world insofar as we respond to aspects of our environment. In this context, to say that an emotion is a response to x is tantamount to saying that x is a reason for which we have it. Elaborating this claim in light of a historically prominent conception of the active/passive distinction, I will argue that emotions are a form of spontaneity in virtue of their responsive character and contrast in this respect with perceptions, which are fundamentally receptive. While this proposal is prima facie opposed to the ordinary image of emotions as passive, I will show that it actually allows us to make proper sense of it. (shrink)

Using an event-study framework, we examine the stock market reaction to the announcement of firm withdrawal from countries designated as “State Sponsors of Terrorism” by the U.S. Department of State. We find that such announcements are, on average, linked to a statistically significant increase in firm value—an effect which already kicks in a few days before the announcement date. The observed abnormal returns are positively associated with the U.S. domicile, the intensity of a firm’s hitherto existing engagement in a designated (...) country, the number of countries that it withdraws from, as well as with a withdrawal from Iran compared to a withdrawal from other countries. Evidence suggests an increase in demand for stocks of withdrawing firms as a plausible cause of the positive stock price reaction. Pension and endowment funds are significantly less likely to own strategic stakes in firms with intensive involvements in countries designated as “State Sponsors of Terrorism.” We find some statistical evidence that firms remaining active in such countries have abnormally positive returns in the long run. We ask what type of neutralization techniques corporations apply to allegations of human rights abuses. We proceed by undertaking a Qualitative Content Analysis of 162 responses by ten extractives-sector firms over a period of 14 years. The firms were responding to accusations of human rights impacts documented by the Business and Human Rights Resource Centre. We use Garrett et al.’s :507–520, 1989) framework of neutralization techniques consisting of denial, justification, concession and excuse to examine the responses. During our QCA, we (...) observed emerging themes around self-promotion and evasive tactics. We contribute to existing literature by proposing ‘evasion’ as a novel neutralization technique, particularly in circumstances of corporate responses to accusations of wrongdoing. We argue that evasion occurs when firms refuse to engage in the debate brought forward in an accusation. In addition, we enrich our understanding of neutralization techniques by proposing subneutralization techniques in our analysis to diverge from that of other studies. We conclude by discussing the implications of the predominance of corporate narcissism and evasive neutralization techniques to the business and human rights movement and other international corporate responsibility standards. Emotion Review, Volume 14, Issue 4, Page 244-253, October 2022. This article is a précis of my 2019 monograph The World-Directedness of Emotional Feeling: On Affect and Intentionality. The book engages with a growing trend of philosophical thinking according to which the felt dimension and the intentionality of emotion are unified. While sympathetic to the general approach, I argue for a reconceptualization of the form of intentionality that emotional feelings are widely thought to possess and, accordingly, of the kind of (...) role they play in our mental lives. More specifically, I argue that the way we feel in having an emotion is not a perception-like awareness of evaluative properties of its object, but instead constitutes the taking of a stand or position on this object in light of its evaluative properties. According to much recent work in metaethics, we have a perceptual access to normative properties and relations. On a common approach, this access has a presentational character. Here, ‘presentational’ specifies a characteristic feature of the way aspects of the environment are apprehended in sensory experience. While many authors have argued that we enjoy presentations of value properties, thus far comparatively less effort has been invested into developing a presentational view of the apprehension of normative reasons. Since it appears that this (...) view would offer much the same theoretical benefits as presentational views of the apprehension of value, it seems worthwhile redressing this imbalance. My paper aims at doing so, focusing on concern-dependent practical reasons. After clarifying the central commitment of this view, I assess a recent proposal by Dancy :787-812, 2014) which provides a detailed characterization of the relevant type of cognition. I argue that Dancy ignores one of the central features of a presentational access to normative reasons and therefore misidentifies which actual psychological phenomena are apt to play this role. In this context, I also assess and reject further candidates that might seem fitting for this purpose. In the remainder of the paper, I then offer a more adequate account which specifies an actual form of presentational access to concern-dependent practical reasons and provide the contours of a more substantive account of its nature. According to a popular thought, sympathy is an epistemic phenomenon: in sympathizing with others we come to be aware of them as fellow sentient beings. This view–which I call the Epistemic View–effectively characterizes sympathy as a form of social cognition. In this paper, I will argue against the Epistemic View. As far as I can see, this view radically misconstrues the way sympathy is directed at others. I will at the same time provide some material for, and motivate, an alternative (...) proposal according to which the primary significance of sympathy is practical rather than epistemic. On this account, sympathy is a form of interpersonal acknowledgment rather than interpersonal awareness. (shrink)

This paper examines the effectiveness of public enforcement by studying the effects of regulatory intervention to curb tunneling through intercorporate loans in China. Specifically, we explore whether public enforcement efforts in 2006 resulted in less tunneling, and ultimately in increased performance for tunneling firms. We show that tunneling is among the dominant factors increasing the likelihood of becoming blacklisted. We also find that firms’ tunneling mechanisms decreased significantly after the regulatory shock, and that their performance increased significantly compared to non-tunneling (...) firms after the regulatory shock. Finally, we find a positive market reaction to the public announcement of tunneling both for firms that have been blacklisted and other tunneling firms that are not blacklisted. Collectively, these results suggest that public enforcement in the presence of a credible threat succeeds in deterring the effect on tunneling behavior in China. (shrink)

A possible event always seems to be more probable than an impossible event. Although this constraint, usually alluded to as regularity , is prima facie very attractive, it cannot hold for standard probabilities. Moreover, in a recent paper Timothy Williamson has challenged even the idea that regularity can be integrated into a comparative conception of probability by showing that the standard comparative axioms conflict with certain cases if regularity is assumed. In this note, we suggest that there is a natural (...) weakening of the standard comparative axioms. It is shown that these axioms are consistent both with the regularity condition and with the essential feature of Williamson’s example. (shrink)

Many metaethicists endorse a cognitive constraint which links the reasons for which we act or hold attitudes (motivating reasons) to normative reasons (reasons that speak in favour of an action or attitude). As traditionally formulated, this constraint (known as the Taking Condition) requires that an agent’s motivating reasons are mentally represented by her as corresponding normative reasons. In response to the charge that the Taking Condition is overly demanding, Errol Lord and Kurt Sylvan have proposed a reformulation which eschews the (...) need for normative representation (Lord and Sylvan 2019 [“Prime Time (for the Basing Relation).” In Well-Founded Belief, edited by J. Adam Carter, and Patrick Bondy, 141–173. London and New York: Routledge]). As they argue, agents must treat their motivating reasons as normative reasons, where this notion picks out a specific set of dispositions rather than a representational state. I argue that this proposal seriously distorts our understanding of the relation between an action or attitude and the reasons for which we perform or hold it. On the plausible assumption that an account of motivating reasons should not stray too far from this understanding, this response to the over-demandingness charge thus fails. I also provide some directions on how friends of the Taking Condition should instead respond this charge. (shrink)

At least since the late Early Modern period, the Holy Grail of ethics, for many philosophers, has been to say how ethical values could have a kind of protagorean objectivity: values are to be both fully objective as values and yet depend on us by their very nature. More than any other contemporary foundational approach it is “constructivist” theories, such as those due to Rawls, Scanlon, and Korsgaard, which have consciously sought to explain how protagorean objectivity is a real possibility. Yet there remains considerable uncertainty about what the various versions of constructivism have in common, what, if anything, “constructivism” as a general approach is supposed to accomplish, and whether, if it is a general approach, it amounts to a distinctive foundational view. In his The Nature of Sympathy, Max Scheler (2007 [1923]) offers an intriguing, if puzzling, account of empathy. According to this account, empathy is a specific kind of feeling through which we are immediately aware of others’ emotions but which is not itself an emotion and doesn’t require us to have those emotions ourselves. Moreover, qua immediate awareness of others’ emotions empathy is supposed to afford understanding why they feel those emotions. Although having echoes with ordinary discourse and experience, Scheler's (...) proposal has met with some scepticism. In this chapter, the author defends Scheler's conception against two key objections, which target its coherence. According to the first, it is difficult to see how one could feel another's emotion without having her emotion oneself. The second objection focuses on the claim that feeling-after is a form of understanding. Since feeling-after is a direct awareness of another's emotion and, as such, does not seem to provide access to the reasons for which she feels it, it is hard to see how it could make her emotion intelligible to us. The author argues that these objections fail since they confuse different forms of feeling and do not appreciate the constitutive connection between emotions and reasons, respectively. (shrink)

The executive board of the Academy for Ethics in Medicine and two AEM working groups formulated standards and recommendations for clinical ethics consultation in 2010, 2011, and 2013. These guidelines comply with the international standards like those set by the American Society for Bioethics and Humanities. There is no empirical data available yet that could indicate whether these standards and recommendations have been implemented in German hospitals. This desideratum is addressed in the present study. We contacted 1.858 German hospitals between (...) September 2013 and January 2014. A follow-up survey was conducted between October 2014 and January 2015. The data of the initial survey and the follow-up survey were merged and evaluated. The statements of the participants were compared with the standards and recommendations. The standards of the AEM concerning the tasks of clinical ethics consultation are employed by a majority of participants of the study. Almost all of these participants document their consultation activities by means of protocols or entries in the patient file. There are deviations from the recommendations of the AEM working groups regarding the drafting of statutes, activity reports, and financial support. The activities of clinical ethics consultation predominantly comply with the standards of the AEM and recommendations for the documentation. The recommendations for evaluation should be improved in practice. This applies particularly for activity reports in order to evaluate the activities. Internal evaluation could take place accordingly. (shrink)

We argue that existing accounts of technomoral change do not fully explain its disruptiveness. This explanatory gap can be bridged by examining the epistemic dimensions of technomoral change, focusing on moral uncertainty and inquiry. To develop this account, we examine three historical cases: the introduction of the early pregnancy test, the contraception pill, and brain death. The resulting account highlights what we call “differential (...) disruption” and provides a resource for fields such as technology assessment, ethics of technology, and responsible innovation. Moritz Schulz explores counterfactual thought and language: what would have happened if things had gone a different way. Counterfactual questions may concern large scale derivations or small scale evaluations of minor derivations. A common impression, which receives a thorough defence in the book, is that oftentimes we find it impossible to know what would have happened. However, this does not mean that we are completely at a loss: we are typically capable of evaluating counterfactual questions probabilistically: we can say (...) what would have been likely or unlikely to happen. Schulz describes these probabilistic ways of evaluating counterfactual questions and turns the data into a novel account of the workings of counterfactual thought. (shrink)

According to Robert Baker, moral disruption is a process in which technological innovations undermine established moral norms without clearly leading to a new set of norms. Here I analyze this process in terms of moral uncertainty, formulating a philosophical account with two variants. On the harm account, such uncertainty is always harmful because it blocks our knowledge of our own and others’ moral obligations. On the qualified harm account, there is no (...) harm in cases where moral uncertainty is related to innovation that is “for the best” in historical perspective or where uncertainty is the expression of a deliberative virtue. The two accounts are compared by applying them to Baker’s historical case of the introduction of mechanical ventilation and organ transplantation technologies, as well as the present-day case of mass data practices in the health domain. This paper sets out an account of trust in AI as a relationship between clinicians, AI applications, and AI practitioners in which AI is given discretionary authority over medical questions by clinicians. Compared to other accounts in recent literature, this account more adequately explains the normative commitments created by practitioners when inviting clinicians’ trust in AI. To avoid committing to an account of trust in AI applications themselves, I sketch a reductive view on which discretionary authority is exercised by AI (...) practitioners through the vehicle of an AI application. I conclude with four critical questions based on the discretionary account to determine if trust in particular AI applications is sound, and a brief discussion of the possibility that the main roles of the physician could be replaced by AI. According to the traditional view in the philosophy of logic facts of logic bear normative authority regarding how one ought to reason. Usually this is to mean that the relation of logical consequence between statements has some special relevance for how one’s beliefs should cohere. However, as I will argue in this article, this is just one way in which logic is normative for reasoning. For one thing, belief is not the only kind of mental state involved in reasoning. Besides (...) adopting and revising beliefs, rational agents pose and resolve questions. For another thing, the consequence relation of classical logic can be conservatively extended such that it includes logical relations between questions as well. Therefore, there is an argument to be made that not only the inference of new beliefs from extant beliefs but also the process of raising additional questions falls under the normative authority of logic. Accordingly, a nuanced account of the normativity of logic presents itself, which convincingly deals with problems such as clutter-avoidance and the paradox of the preface. (shrink)

I contrast two approaches to the interpretation of generics such as ‘ravens are black:’ majority-based views, on which they are about what is the case most of the time, and inquiry-based views, on which they are about a feature we focus on in inquiry. I argue that majority-based views face far more systematic counterexamples than has previously been supposed. They cannot account for generics about kinds with multiple characteristic properties, such as ‘elephants live in Africa and Asia.’ I then go (...) on to sketch an inquiry-based view. (shrink)

A person sometimes forms moral beliefs by relying on another person''s moral testimony. In this paper I advance a cognitivist normative account of this phenomenon. I argue that for a person''s actions to be morally good, they must be based on a recognition of the moral reasons bearing on action. Morality requires people to act from an understanding of moral claims, and consequently to have an understanding of moral claims relevant to action. A person sometimes fails to meet this requirement (...) when she relies on another person''s moral testimony, and so there are moral limits on such reliance. (shrink)

Bernhard Nickel presents a theory of generic sentences and the kind-directed modes of thought they express. The theory closely integrates compositional semantics with metaphysics to solve the problem that generics pose: what do generics mean? Generic sentences are extremely simple, yet if there are patterns to be discerned in terms of which are true and which are false, these patterns are subtle and complex. Ravens are black, and lions have manes: statistical measures cannot do justice to the facts, but (...) what else is there that has a hope of giving us insight into what we are capturing across so many domains? Nickel argues that generics are the top of a fundamentally explanatory iceberg, and that this explanatory framework is deeply intertwined with the semantics of the language we use to express them. In providing an integrated semantic and metaphysical theory of generics, he aims to solve old puzzles and draw attention to new phenomena. (shrink)

Die Allgemeine Erkenntnislehre gilt als das Hauptwerk von Moritz Schlick. Hierin entwickelt Schlick in Auseinandersetzung mit zeitgenössischen Positionen seine einflussreichen Gedanken zum Wesen der Erkenntnis, zum Verhältnis zwischen Psychologie und Logik, zum Leib-Seele-Problem und zum erkenntnistheoretischen Realismusstreit. Der Text wurde während der frühen Rostocker Jahre Schlicks, von 1911 bis 1916, verfasst. Die Allgemeine Erkenntnislehre ist ein Meilenstein der wissenschaftlichen Philosophie und grundlegend für die spätere Entwicklung des Wiener Kreises des Logischen Empirismus.
